OFFICERS JUSITIFED IN SHOOTING EAST COUNTY MAN WHO THREW CHEF'S KNIFE AT POLICE, DISTRICT ATTORNEY FINDS

January 28, 2011 (San Diego’s East County) – District Attorney Bonnie Dumanis has concluded that the non-fatal shooting of Huong Quy Luu on July 25th was justified. San Diego Police Officers Blake Williams and Christopher Blakely “fired in self-defense as well as in defense of one another,” a letter issued by Dumanis on January 24 states.

 

The officers had responded to a domestic disturbance call involving a violent man breaking out windows in the 6900 block of Jamacha Road.

 

A dispatcher informed officers that children were “running around screaming” and that a female adult had fled to a neighbor’s home. Officers found windows on Luu’s home, as well as glass on several parked vehicles, had been smashed.

 

Armed with a mallet and a knife, Luu threw a chef’s knife at Officer Blakely before arming himself with additional knifes and running toward the officer, who then fired five times. Wounded, Luu fell to the ground, crawled forward and tried to throw a second knife. Officer Blakely responded by firing once at Luu, who was treated at the scene and transported to a local hospital. The officers have attested Luu ignored repeated orders to drop his weapons. Six knives were recovered from the scene.
 

Luu waived his Miranda rights and spoke through a translater, according to the D.A.’s statement. “Mr. Luu said it was the end of the road for him and he did his best to have the officers shoot and kill him,” she added. “Mr. Luu explained that he tried to cut his throat and kill himself and wanted to die that morning because he had lost everything, had no more money and wasn’t going to have anywhere for him and his family to live.”
 

Luu pled guilty on November 1st to one felony count of assault with a deadly weapon on a peace officer. His sentencing is scheduled form March 16, 2011.
