DRUNK DRIVER SENTENCED TO 15 YEARS FOR KILLING HOMELESS PEDESTRIAN IN EL CAJON

September 12, 2018 (El Cajon) – Joshua Colby Ness, 33, of Lakeside was sentenced to 15 years in state prison for hitting and killing Michael Rourke, 60, a homeless man I El Cajon.  Ness, who fled the scene but later turned himself in to police, pled guilty to gross vehicular manslaughter.

His blood alcohol level was tested at between .11 and .16 percent, substantially over the .08 level limit in California. Ness had a prior conviction in 2010 for misdemeanor DUI.

The accident occurred on October 10th last year at 10 p.m., when Ness was driving a Dodge Charger and struck O’Rourke, who was crossing North Second Street near Madison Avenue.
