COMPLAINT CHALLENGES DOGE ACTIONS AS UNCONSTITUTIONAL

February 20, 2025 (Greenbell, Md.) -- A legal complaint filed by 26 unnamed former and current employees in the U.S. District Court for the District of Maryland alleges that Elon Musk and the Department of Government Efficiency (DOGE) has violated the Constitution’s Appointments Clause.  That clause mandates that presidential appointments require the advice and consent of the Senate, which President Donald Trump did not seek when he appointed Musk and delegate vast powers.

Musk, without any Congressional approval, has virtually deleted entire agencies such as USAID, accessed millions of Americans’ private data, deleted government records such as health reports and  records on missing and murdered indigenous persons, and ordered mass firings, some without required authorization. Even employees charged with overseeing air traffic safety and nuclear weapons lost their jobs in the purge by Musk’s team.

“Questions regarding Defendant Musk’s and DOGE’s role, scope of authority, and proper appointment processes are not merely academic. Plaintiffs — among countless other American individuals and entities — have had their lives upended as a result of the actions undertaken by Defendants Musk and DOGE,” according to the lawsuit.

The employees, though unidentified, collectively have decades of service at federal agencies, including USAID, where on Feb. 2 Musk’s DOGE personnel broke into the agency’s headquarters and cancelled international aid programs such as those to ease hunger in Africa, Gaza and Ukraine, distribution of vaccines and life-saving medicines in countries around the world.

Citing damages to their careers and financial security, the plaintiffs are asking the court to block “Defendant Musk and his DOGE subordinates from performing their significant and wide-ranging duties unless and until Defendant Musk is properly appointed pursuant to the U.S. Constitution.”

The lawsuit is one of several filed over DOGE’s actions, though the first based on the Constitution’s appointments clause.

Elon Musk is a Soth African immigrant via Canada by way of his mother gaining him American citizenship. Trump has spoken negatively about former, 2 term president Obama as not a legal citizen because he was born in Hawaii, so why is Musk vetted to do Trumps bidding? Elon Musk has admitted that he regularly ingests Ketamine, a dissociative anesthetic which has some hallucinogenic effects which causes the user to become detached from their environment (reality). Musk is proposing sending $5,000 to every current taxpayer (not the poor who need it) as a payback for finding all the money paid out in government waste. I believe this is another tactic to placate any negativity towards him and Trump. More smoke and mirrors. The national debt under Trumps first term rose by $7.8 trillion. Trump and Musk want extended and possibly add additional tax cuts for the wealthy top tier. Consequently this will be paid for by huge funding cuts to Medicare - Medicaid, Housing, SNAP, Social Security benefits and programs designed to help the poor and needy. Funding cutbacks are coming to Veterans who serve our country as well as the VA which assists disabled vets. Ongoing job terminations by the thousands will not help anyone. More unemployed needing government assistance and less dollars being paid in taxes. Many republicans who voted for Trump now regret it. BTW, I don't obtain information from fake news sources like social media, especially X. A storm is brewing like we've never seen before our lifetime. DOGE: Destruction or Grifting Everyone.

DOGE and Musk are not actually sanctioned as employees. Therefore have no legal authority to do anything, let alone acting as if he's the duly elected president of the United States. So why is he getting away with these shenanigans? No doubt the republicans are scared of Trump and his vindictive nature. If the democrats were to do anything similar, the republicans would be hollering about it and putting a stop to these actions. Yet the silence continues...Democracy? Republic? Not so much anymore.

You and your grandkids can keep paying paying for the $37 TRILLION national debt if you're so happy with the status quo. Everyone I know fully support Musk leading DOGE in doing what's needed to be done under decades of Republican and Democrat leadership - slash waste, identify fraud, and root out the foolish spending by unelected bureaucrats.
